Sure, the conventional wisdom is that the individual mandate of the Affordable Care act will be thrown out by the Supreme Court when it announces its decision at 10 am tomorrow.
But a very persuasive anti- conventional wisdom crowd think the law will be upheld and they have some very convincing arguments.
- There’s respected Harvard Law Professor (and Bush v. Gore lawyer for the good guys) Lawrence Tribe.
- There’s our frequent guest, the former Labor Secretary and all around genius Robert Reich.
- And there’s SCOTUS blog columnist Tom Goldstein.
It’s all part of our fantastic Big Finish tonight... as the Vice President would say, it's a big effin deal!

It for sure is a BFD. We will win.
It will be 6-3 upheld. IMO.
I love that my healthcare will soon accept pre-existing conditions. Romney's 26 year old daughter IS still on his health-care plan:O
Carly, Romney does not have a daughter that I know about. However, he has set his sons up in well-paying jobs when he was governor of MA. In fact, one son was paid a year after the election with campaign funds. Not legal to do.
Brown's daughter is on the healthcare plan of her parents. She is over 20.
It was Scott Brown's daughter that is benefitting from the Affordable Care Act while her father is busy campaigning against it.
yes carly dear, scott brown's daughter benefits while her dad opposes it. also, robme opposes it because obam appeoves it.
Just go to show who the hypocrites are.
oops approves it. sorry
That opponents of the ACA are benefitting from it's provisions should not be a surprise. I mean, do you think the ordinary Joe that gets a refund check from his insurance company is going to mail it back to them stating "Thanks but no thanks. You guys earned this"? Not going to happen.
According to Lawrence O'Donnell there IS NO mandate. Because there is NO penalty if you don't buy into it. No monetary fine, no jail time. So if that is true and taken into consideration by the SC, maybe it WILL stand.
Why would a 26 year old adult need to be on their parents HeaLth care? If they were still in college would be the only reason I could think of. My suggestion for young adults would be to do at leat 2 years in the miltary or reserve. Not only will you have health care for life you also can benefit from the GI bill. Not to mention it will teach you dicipline. However dont do like I did and go airborne you will almost certainly end up jumping into combat somewhere. I was in for only 3 years 1989 to 1992 ( operation just cause and Deasrt storm).
It's quite frequent that young adults are in college until they're at least 22 years old and even more frequent that their first jobs out of college don't provide adequate health care coverage. I know in my case my first job with quality health care coverage wasn't until about 16 months after I graduated from college (albeit with a Master's Degree), so even though I graduated young I was still over 23 years old before I had health coverage.
If there is any decency left in the United States of America, then the Affordable Health-care Act (should) be upheld in its entirety.
It is right and a good thing to have health-care benefits for all citizens of this country!
Obama/Biden 2012 ~ Forward
especially since it doesn't mess with their healthcare.
If it wasn't for children being able to stay on their parents healthcare plan until age 26, my daughter would be in terrible debt. She was diagnosed with Inflammatory Colitis 3 years ago and was a full time student until the end of 2011 when she received her Bachelor's degree. If not for Obamacare, she would have been off of our policy at age 23. She is now 25 and will be eligable for her healthcare at her new position in 6 months. She has to see her physician everytime she has a really bad flare up. It's been a real blessing that she is still covered under our policy.
With a single payer system, everyone would be able to do have access to whatever health care they need
It is not just direct insurance company overhead costs of 20% to 25% involved (only that low with the ACA, 30% to 35% without the ACA).
Ongoing access to proper health care cuts costs in and of itself, because things are diagnosed and treated when they are small and cheaper to fix, and chronic conditions (like diabetes and hypertension) can cause serious and costly damage if not treated with ongoing proper health care and maintenance. Single payer saves money because treatment is not deferred for months, years, and decades, due to inability to pay.
I hope that at least 5 of the justices have the decency to say this is constitutional. I don't believe a professor of the constitution is going to go against it with a new law.
How can it be a mandate if there is no enforcable penalty. There is a small fine but if it is not paid nothing happens, there's no fine or penalty for not paying the fine.So where's the mandate part?
it is a watered down mandate. consider it encouragement to purchase healthcare. The more important part is premium support which increases the less money you make.
It is still a corporate sell out. consider this if snap/food stamps didnt exist and it were being incepted, the mandate with premium support would be like giving vouchers to eat out at restaurants, instead of help buying groceries.
The justification being: Well there is a whole industry of food preparation, we cannot circumvent it! we must bolster the corporate food producing machine off the tax base!!
The waste is equvocal. some $5,000,000/year will make more because the tax base will be buying overpriced insurance instead of seeking the lowest cost option to ensure everyone eats/can go to the doctor
I PRAY that it stands, I wish I had more confidence in our supreme Court( I don't think it's a nonpolitical court!! )We can not afford to have anymore Republicans on the Supreme Court.
I am an INDEPENDENT --This November I will not even consider any republicans when I Vote!!!
Amen!
I double amen that. Republicans have laid there cards on the table and i donot like how they play a cheating game!
I hope the Supreme Court will do the right thing this time. For little ones and people of all ages if they strike this down many with pre existing conditions will die its that simple. They would give substies to oil company's and denies a nation health care. Fair there is no way its fair. We are the huddle masses and the poor, and yet it seems like the Republican party have forgotten who and what made this country great. The rich would not be rich if it wasn't for the middle class. They destroy the middle class , there house of golden cards will fall as well !
If ANY, I mean ANY Democrats, I mean ANY of them think we, their supporters are so LITTLE; yet, get scared of the NRA threat to vote with Issa against Holder, we, their supporters SHOULD teach them a lesson too.
I cannot understand why they are so timid.
a) NRA will always threaten them; but they have to be DEVOTED to us - their supporters, not NRA, they do not see any Republican do that, we will show them who their supporters are.
b) It is about time they STAND up for their own. Holder should not be left stranded because of threats from NRA. NRA etc will always, always come. If they do not threaten on this, it would be something else…
c) Democrats need to know how their bread is buttered. We are their voters not NRA. They must be forgetting themselves that GOP do not vote for them, we do.
I want to know the names of any Dems who vote with the Repubs on this. And if there are any from my state they aren't ever going to get my vote again.
More like...The DELUSIONAL...
just saying...
Look its more of capt entitleds wisdom for the tea bagged.
I hope Roberts, the chief Justice, & his republican cronies on the SCOTUS remember that they were appointed to serve the people of the USA not the republicans only!!!!!
I pray they do the right thing. If they dont, this will be another dark stain on the pages of infamy of the history of the USA, right up there with the Citizens United decision & Gore vs Bush. The people of this country will no longer trust the Highest Court in the land & that would be a very sad day for this Great Country!!!
White Floridian
Never hurts to be a touch dramatic...
The sad thing about this over 2,000 page health care bill, is that no one really knows everything this bill does. I'm sure there are some good thing in the bill but there are also bad items as well. The main problem I have is that congress was forced to vote on this bill before the ink was dry. To quote the moron nancy pelois "We have to pass the bill so we can find out what is in itl". That quote is a sad representation of our current elected officials in Washington. obama ran for President saying that he would make sure that his administration would be transparent , without the back room deals and nothing could be further from the truth!
The Affordable Care Act is a decent bill but hard for many to understand. Appear to support individual parts of it. Most Americans would readily accept a Medicare for all public option once it was passed into law and adequately funded. The trouble is getting from where we are today to where we must go tomorrow. Perhaps the Supreme Court will make the journey a bit longer or more trying but with health insurance costs doubling every seven to ten years most middle class people will need a Medicare for all public option or Medicaid very shortly in the coming years. Our current health care system is a dead man walking with huge costs and 50 million uninsured. In ten years we could have 70 to 80 million uninsured and at least that same number under-insured.
This condition won't be allowed to happen because it would endanger our national security and endanger our national competitiveness. By 2020 projections are that private health insurance premiums will be $26,000 annually. No small business or small company or their employees can afford this costs. So all that will be left is national decline and endangerment of our economic and national security or a Medicare public option.
Ed, you and the PCCC are kidding yourselves. The Supreme Court ruling will NOT open the door to single payer or people buying into Medicare, because the repuglicans will never allow that to pass either the House or Senate.
I'll be perfectly honest with you I though this was going to be overturned and I know I'm not alone on this one. In fact I know I'm not a lone everyone is talking about it. The GOP are crying the blues and mitt who is full of sh-- said he would repeal this the first day in office hold up there deputy dog you can't do that and you know it another bull crap statement don't you think this will back fire on you in the debated Obama will rip you apart can't wait..huge win for America.
All I can say is Mitt Romney "You Lie!"
