George Zimmerman, the neighborhood watch volunteer who fatally shot unarmed black teenager Trayvon Martin, will not be charged with first-degree murder.
Angela Corey, the special prosecutor who's deciding whether to file charges, announced today that she's not going to take the case to a grand jury, a step that is required in a first-degree murder case.
Martin was killed Feb. 26 during a confrontation with Zimmerman in a gated community in Sanford, Florida. Zimmerman has claimed self-defense.
Corey could still charge Zimmerman with a serious felony such as manslaughter, which can carry a lengthy prison sentence.
Is Corey's decision good or bad news for those who want to see Zimmerman arrested? All sides appear to be cautiously hopeful.
"We are not surprised by this announcement and, in fact, are hopeful that a decision will be reached very soon to arrest George Zimmerman," Benjamin Crump, a Martin family attorney, said in a statement.
Civil rights leader (and MSNBC host) Rev. Al Sharpton also issued a statement saying the decision "vindicates the position that we have taken all along - that is you do not need a grand jury to make an arrest of George Zimmerman on probable cause."
"Courageous move on her part," Hal Uhrig, one of the lawyers representing the Zimmerman family, told CNN. Uhrig also said was not surprised by Corey's decision.
An Orlando criminal defense attorney tells The Associated Press the decision means Corey won't have to rely on potentially-unpredictable jurors. David Hill says Corey may know that there isn't enough for a first-degree murder charge, but she wants to charge him with something else -- and she now can"maintain control" of that process.

Okay, fine. As long as this guy is ultimately arrested on a charge that says he unlawfully caused the death of Trayvon Martin, I'm okay with it. Granted, we don't know all the particulars and there is so much that will never be known so I see how the first degree charge doesn't apply. Furthermore, I don't think Zimmerman followed Trayvon with the premeditated intent to kill him. However, I think his unnecessary use of deadly force, bolstered by his awareness of Florida's controversial "Stand Your Ground Law," caused him to make a decision that directly resulted in this young boy's death. 2nd degree murder or voluntary manslaughter will be just fine as long as his prison sentence is LENGTHY!

What evidence do you have that Zimmerman brandished a weapon at any time prior to the time of the shooting? If Zimmerman was justified in the shooting, then he had every right to draw his weapon.
Harassment seems to fall under the stalking laws in Florida and as is noted below, it does not appear that he violated that law.
The general requirement of most menacing laws involves both intent and a reasonable fear of severe bodily injury after a weapon of some sort has been displayed. there is no evidence to support the contention that Zimmerman drew his weapon prior to the time the shooting occurred.
As far has violating his civil rights, can you expand upon exactly what civil rights you think were violated and the evidence you have to support your accusation?

The evidence is not all in regarding why he is dead...that is why we are still waiting on the State Attorney to decide IF there is reason to move forward with an indictment and a trial.
I did see where NBC News stated officially that it was merely a mistake and not intentional- there editing of the tape to make it appear different than reality. Then they fired the producer, at least, the firing part is widely reported but not confirmed by NBC. Since Ed showed that version- will he come clean on it tonight?
NBC doesn't have the original. What good would it do to "edit" a copy. Get real.
Since much of the critical forensic evidence was never collected and is now lost forever, a murder 1 case would be very difficult to prosecute successfully. That is the reality of the situation.

MD/Ml~ Two weeks ago I said I thought he inflicted his own injuries(if there really were injuries) himself. I thought he might have banged his nose and the back of his head on his truck, but I didn't realize he was so far away from the truck. Now I think he did it with the butt of the 9mm. That's why the cuts are close to the top of his head. He couldn't get his short, fat little arm any further back to get to the middle of the back of his head. And if he broke his nose, where's the blood on the front of his shirt? He walked into that police station looking like he'd gotten nothing more than a speeding ticket instead of killing someone in a supposed life or death battle.

Fights in the real world are over in a matter of seconds. For a fight to go on for a whole minute would mean one or the other would be absolutely pummeled. Didn't Z tell the cops he was getting his head bashed for five minutes? I know he said longer than a minute, but from the time Trayvon's girlfiend's phone got disconnected and the gunshot was heard on the 911 tape was 1 minute. Unfortunately, without contradictory evidence, the legal authorities have to go on what they have. They are not allowed to go with terms like "probably". That term in itself gives cause for reasonable doubt to be established by defense team.

i have never said it is right for NBC or fox news to edit tapes. NBC usually reacts to something like this by firing or suspending the offender. i can't think of one reporter over there at fox who has been suspended for editing tape, or for calling our president names, or etc.
glenn beck was finally let go, but that is because fox news was losing money, it wasn't because of anything he said, really.

A simple question for you...what evidence do you know of that supports your statement that there was a "unnecessary use of deadly force"? The information that has been released so far indicates that Martin was beating Zimmerman and the enhanced ABC tape confirms that there were injuries to the back of Zimmerman's head, which would give reason to believe that Zimmerman MAY have had reason to fear for his life.
That being said...if there is evidence to the contrary which shows that Zimmerman did use unnecessary deadly force, I hope that they do throw the book at him and put him behind bars for a long time. However, at this point, there is no known evidence which can support that line of thinking.
There is evidence, Denice. Under Florida caselaw, simply stalking someone is enough to prove aggression under the self-defense statute. Zimmerman admitted that he left his car to follow Trayvon. That is stalking. He had already followed him in his car. Trayvon's girlfriend will testify that he said he was being followed and that he was afraid of Zimmerman. So, Zimmerman is the initial aggressor.
There is enough evidence to prosecute him for second degree murder. He will have to prove proportional use of self-defense. He will have to show that A REASONABLE PERSON would have feared for his life or serious bodily injury.
Stormy Guy - Because Zimmerman was stalking Trayvon, he was the initial aggressor under Florida law. Because he was the initial aggressor, he had a duty to retreat. He could have told Trayvon, I have a gun and I will use it. It is clear that he didn't say that. Trayvon was screaming for his life. So - yeah, the dude is guilty of second-degree murder. The tapes will convict him.

Well...Trayvon;s father has said that it was not his son;s voice on the tape and Zimmerman's family has said it was George. additionally, the only know eyewitness places Martin on top of Zimmerman beating him.
One important issue will be what is the definition in Florida of stalking. The known "evidence" at this point indicates that Martin made the initial contact with Zimmerman. It is not known if Zimmerman "confronted" Martin in any way prior to the reported punch that Martin hit Zimmerman with.
According to the website I visited, here is the definition of stalking in the state of FL..
Section 784.048. STALKING; DEFINITIONS; PENALTIES. 1997.
(1) As used in this section, the term:
(a) "Harass" means to engage in a course of conduct directed at a specific person that causes substantial emotional distress in such person and serves no legitimate purpose.
(b) "Course of conduct" means a pattern a conduct composed of series of acts over a period of time, however short, evidencing a continuity of purpose. Constitutionally protected activity is not included within the meaning of "course of conduct." Such constitutionally protected activity includes picketing or other organized protests.
(c) "Credible threat" means a threat made with the intent to cause the person who is the target of the threat to reasonably fear for his or her safety. The threat must be against the life of, or a threat to cause bodily injury to, a person.
(2) Any person who willfully, maliciously, and repeatedly follows or harasses another person commits the offense of stalking, a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.
(3) Any person who willfully, maliciously, and repeatedly follows or harasses another person, and makes a credible threat with the intent to place that person in reasonable fear of death or bodily injury, commits the offense of aggravated stalking, a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(6) Any law enforcement officer may arrest, without a warrant, any person he or she has probable cause to believe has violated the provisions of this section.
Under those terms, it does not seem that Zimmerman's actions would raise to the level of stalking because of the absence of "repeatedly" , there was no threat made that we know of, and it appears that Zimmerman had a right to be in the area.

Oh -sorry, Florida law doesn't require grand jury indictment for First-Degree murder, but it is pretty clear that Zimmerman didn't go outside that night looking to kill Trayvon Martin. He can be convicted of Second-Degree murder - which carries a life sentence as well.
I realize Z probably didn't go out that night with the intent to kill Trayvon Martin. But....as evidenced by his refusal to back off at the direction of the 911 dispatcher, he absolutely DID go looking for a confrontation. And that's where the weapon comes in. People don't go looking purposely for a confrontation if they think there's a chance they're going to get their a$$ kicked; they take a weapon in case things go very wrong, and they went very wrong that night. Trayvon fought back, in my opinion, as he should have. You cannot go looking for trouble, then when it backfires on you, expect to get away with murder. And @stormguy: He!! yes his civil rights were violated. The kid is walking home from a convenience store! He has that right. He's not breaking any laws, just minding his own business. No one has the right to go hunting for you because you're walking to your house. Everyone knows the bottom line here: if Z had stayed in his truck like he was told to, we would not be having this conversation. Period. If they give him some slap on the wrist like a year or two, people are going to come unglued, and rightfully so.
It means that Corey is probably going to charge Zimmerman with manslaughter (If she charges him at all) and the plea bargain down to some REALLY weak crap like aggravated assault for probation or MAYBE 1 year in jail...

i dont think there will be a plea bargain. more we learn it looks like zimm was justified in shooting martin. as experts are disagreeing with eachother on aspects of the shooting it would be very hard to convict. would be very hard to find an unbiased jury anyway as sharpton, jesse, spike lee , black panthers have called for violence or a boycott of the town. there is no proof zimm is racist and his tutoring black kids in his spare time makes it improbable hes racist. zimm doesnt have to prove hes not racist. prosecuter would have to prove hes racist. in summation it looks like racebaiters sharpton, jesse, black panthers, larry odonnell, ed schultz and others at msnbc and nbc have helped zimm by their foolish actions before the facts come out.

He would been in the hospital. A cat scan would show if he had a concussion so where are they?I read where there could not be first degree murder charges , mainly due to I believe failure of the police dept to collect evidence !

I find it funny that you talk about the KKK being in Florida, but no mention of the NBPP. Which of these two organizations is calling for the unlawful detainment (possible kidnapping) and possible murder of a citizen of the US who has not been indicted on a crime? Additionally, it is my understanding that from a historical perspective that the KKK has no particular love for hispanics any more than they do for blacks. And given that Zimmerman is both caucasian and hispanic, history shows that the KKK would be even more predisposed to not want anything to do with him.

A national magazine for the 911 dispatch industry has already commented that this comment from the dispatcher was not a strong enough statement to prevent Zimmerman from following Martin. It was not a directive to stay in his vehicle. Additionally, this tape does not show that at any time Zimmerman confronting Martin.
Is following stalking? That is for the State's Attorney to decide and for a jury to decide.
Zimmy didn't break any laws. The stand your ground statute protects him from prosecution. There will be no arrest or trial. What he did may not be right but it isn't against the law. Besides, his lawyer will have no problem creating reasonable doubt if this reaches the courtroom. He was instructed to stop by a dispatcher not by a police officer.
You had better read Stand your ground laws before you go out and kill a kid. Stand your Ground means if a person confronts you and you fear he is going to hurt you then you can stand your ground. No where in that does it say that a person can follow then chase another person and shot them when you confront them.It is illegal to play cop in every state of the Union.
It is called Neighborhood WATCH not Neighborhood chase and confront then shoot. The 911 operator has more legal standing then a neighborhood watchman, the watchmans job is to watch and report, not chase and confront, that is illegal because only law enforcement has the legal authority to confront someone not engaged in any illegal activity.
And exactly how did Zimmerman "confront" Martin?
When he caught up to Martin thats when and even the police are calling it a confrontation. Police never bought Zimmerman story that he was walking back to his truck after looking at street signs, there were no streets for him to find signs on where the confrontation took place and his truck was parked on the street somewhere in front of the condos, the confrontation happened behind the condos.
Oh, so it is reasonable to understand why Zimmerman might have gotten out of his vehicle in order to keep an eye on Martin since he had gone to the BACK of the condos. I mean, if he is only allowed to watch Martin, it is hard to do that when you are blocked by buildings.

Go read the definition of stalking under Florida law. I think that it will be very hard for a prosecutor to prove that Zimmerman was stalking Martin when in fact there is no evidence to show that Zimmerman had ever seen Martin prior to that night. Zimmerman had a legal carry permit and did not have his gun with him in case Martin fought back,,,he had it because he carries it with him in the event that ANYONE threatened him.
Assuming that the accusations from people on this blog are true, that he was hunting and stalking Martin, my question would be...why Martin? According to reports, he had called in 40+ times over an extended period of time. What happened for him to finally snap and "track him down like a dog"?
I am not defending Zimmerman...I have said repeatedly that if there is enough evidence to take the case to court and he is convicted, then he should serve time for the crime. I don't know where he is guilty or innocent..that is for the state attorney to prove and for a jury to decide.

the factors that are involved in this case come down to CHOICES, which one person, Zimmerman, made and the CHANCES of another person, trayvon, that was taking away in the back of some condos.
Lastly the police did interview ZIMMERMAN and did do there initial investigation that recommended Manslaughter charges be brought by the d.a.
The cops did there job and the powers that be, tried to sweep this story under the rug, when it was learned that a former judge made some calls and that police recommendation was denied, that may be a a career ender for that original d.a. but thats part of another investigation.

Certainly Obama will make no statement on how Nancy Strait could have been his grandmother or how Bob Strait could have been that uncle who "liberated Auschwitz ". Mitt Romney did not pop up to call for a "thorough investigation", reminding us of why Santorum kinda had a point about him.
Bob and Nancy Strait won't get the screeching coverage that Trayvon Martin got about white racism because a Hispanic neighborhood watch captain shot a black teenager.
In fact isn't it sad that you will only find this story in a UK newspaper?

If your need to suggest that this black teenager killed white folks makes this relative, then too bad your silly enough to see why there not.
I assume you know the difference between a criminal act and a choice. I assume your educated enough to understand REAL TIME conversation and a random act of violence.
