Now the Black Panthers will start shooting much like the White Supremacists do and they will claim "stand your ground". Since Supreme Court gave ok to acquit if your public defender gave you bad advice, there are 20 states with these laws that black citizens can have their sentences overturned and I hope they do. Only when they equalize the crime will ALEC give this fight up and do away with this stupid law. "Stand your ground" everyone. Black, White, Brown, Yellow. Always claim "stand your ground" in these 21 states. I suspect law enforcement and justice will get very tired of this very quickly.
MD/MI: Right. It is obvious the creator of this law did not really give it much thought. It reminds me of those movies about the old west where they had this duels and the victor was always defending himself even though he may have caused the problem. That law is completely and totally moronic. I think in this case Mr. Martin was the one that could plea the standing your ground law. He was walking back home. Of course if someone was following him he did not know who, or why. For all he knew, he was being followed by a murderer or some kind of nut. So, he must have been apprehensive and with flee or fight instinct, he stood his ground. Who knows, he probably asked "Why are you following me?" But the first thing I would do to would be to hit him on the nose. It was night and dark and the street was desolate. No another human being around. You bet, I would try running first, and he did but it did not work.
In the conversation that is in the internet, Mr. Z says that the subject started running. He should have left him alone.
ALEC is there to protect the wealth of the wealthy. Businesses must have been involved in the designing of it. I would investigate more.

If you watched the interview with GZ brother - we all know that Treyvon was talking to his girlfriend when she said the phone suddenly went dead. We now find out from George's brother that George actually grabbed Treyvon's phone from Treyvon and attempted to call 911. At this point - who had the legal right to "Stand your Ground"!

I agree with you.. This is so totally wrong, there is no right in it.. Anyone that has let this sicko go free, can't even call him a person, belong charged with murder along side him......What a sick society we are !!. ALL of OUR children deserve better than this..REALLY makes ME angrey what the parents are going thru & my heart cries for them. 3 days, before they found out, really, really????. and if he did fight, good for him.. md/mi--just since the Law went into effect on Oct 1, 2005, signed by Jebb Bush; 93 cases with 65 deaths, 57 no charges, 7 acquitted. During the first 5 months; 13 shootings, 6 killed, 4 wounded, 1 person armed. All Self Defense cases turned over to the State's Prosecutor. These laws are being passed by republican Legislators in various states controlled by the republican party. 26 states have these laws with 6 more looking at them but on hold until this case is dealt with in Florida. Better make sure you hold your head down in some of these states, some nut job is out there lookin for a fight with gun in hand. You can thank your local NRA.

A couple points and observations...
I sure as hell hope these laws lead to the death of Americans who otherwise would have free reign to break and enter your home with you absolutely defenseless. I can say without question that if I or my family are threatened with bodily harm or death that it won't be us doing the dying. Harsh? Maybe so - but so is the preposterous proposition that we should just bend over and take it. Perhaps those who choose to be defenseless should offer themselves up as the first to be checked with when a thief, robber, home invader, stalker, etc.. is planning out their next mission of mercy. I will NOT be defenseless, I encourage all such lovely Americans to know this and move along to easier feeding grounds, AND I consider those who would disarm us all as a part of or complicit with said enemy.
2) Mrs. Martin, I sympathize with you and your need to reach some sort of satisfactory resolution to this most unfortunate situation, but can you truly believe that what you saw on the police station video "makes this case" because you saw no evidence of blood on Zimmerman in a few mostly-out-of-focus videos? Umm...he was treated at the scene by paramedics who generally tend to clean up wounds. Additionally the blood was reported to be on the back of his head and the videos show primarily frontal or overhead angles.
3) Mr. Ed. A fine example of overstuffed, full of himself idiocy. I agree that O'bama's statements about this situation have been overblown BUT - he has fallen so short of consistency and clarity in his message and failed utterly in what should be a huge part of his mission as Predsident - finding a way to calm the storm and bring about a calmer approach to all of this mess. Instead, there has been NO response at all addressing what may become a much larger issue...see next point please.
4) All the wonderful "caring souls" who have written responses here saying things like "We should all seek justice justifiably" and "This law has provided racist people to take advantage of by killing an innocent person" etc... (note: you skipped wayyy too many English classes). Sooo...the unresponded to and unrepentent publicly racist organization The New Black Panther Party and it's advocates are cool with their one million dollar dead-or-alive bounty on Zimmerman (who, btw, has not been shown to be a racist)? I think that this alone condemns you all - where is the outcry, where are the demands for a swift and decisive handling of this obviously illegal, outrageous, and idiotic promise of vigilante "justice" where "if the government won't handle it we will"? The laws enabling people to protect themselves are bad but a million dollar dead-or-alive bounty is okay? Seeking justice is an after the fact sort of thing...it is my intent in life to not ever need to seek justice, it is my intent to proactively prevent the violation that justice would need to address after the fact.
I suggest you holier-than-thou, better-than-thou, smarter-than-thou, talk-out-of-the-side-of-your-neck folks stop being so blind and closed minded and recognize the fact that it is YOU who foment most of the societal unrest you incorrectly and without identifiable or justifiable cause attribute to "the right" or "conservatives." Saying "well everyone knows thats true" is no longer a reference you can get away with because, guess what, no it's not and no we don't. What we do know is that your self-righteousness is gross, sickening, deadly, and is dying an all-to-slow death. You decry racism, most everyone does, and endorse it's "politically correct" version all in the same breath? Amazing.
So...to quote the newest best face the "enlightened" offers: "If the government won't, we will."
American law has always provided for self-defense and defense of family and home. It is a legal defense to a criminal charge and always has been. Passing a "stand your ground" law is unnecessary, and this case points out the problems that it causes when people interact out in public space, where everyone has the right to be unmolested.
This is an extremely bad law because it cuts off all avenues of formal scrutiny of a person's actions in the exact situation in which detailed scrutiny is required to determine whether the killing actually was self-defense or whether it actually was a murder on the street. It was Zimmerman who was following Martin and not the other way around. Anyone who hurts or kills someone on the street needs to be charged, so that the procedure is begun and then the defendant asserts at trial that he acted in self-defense. You just don't take the shooter's statement as gospel truth and pat him on the back. Usually, people do make statements to police to exonerate themselves. Then, when they are examined during investigation and trial, these statements are shown to be pure baloney.
Mr. Ed, you need to tone down the "stand your ground" law criticism...Please realize that Mr. Zimmerman abused the law and he should stand trial, either criminally or civil. If Florida does nothing, a civil trial may expose more like the deal with O. J. Simpson.
If you want to see more Democrats elected to Congress and the President reelected, you HAVE to present BOTH SIDES. Your constant criticism of "Stand your ground" is going to cost the Democrats votes in Virginia, West Virginia, and Pennsylvania for starters, where there a LOT of rural areas.
New York City is no model for public safety. Don't forget about Kitty Genovese, brutally murdered in 1964 on a public street, no police response, no one bothered to help her. How about Bernard Goetz, who was assaulted on a NYC subway and he DID stand his ground, only to be railroaded and sent to prison on account of violation of the NYC gun law? There is a long list of murders in NY City that could have been prevented if "stand your ground" was the law in New York.
Same deal with Washington, DC, except the Supreme Court correctly threw out their handgun ban and oppressive registration laws a few years ago. One of Sen. Shelby's aides was brutally murdered on a DC street and had no way of defending himself. Don't forget about Bernard Welch, who committed numerous robberies in DC and murdered a prominent doctor (Dr. Michael Halberstam) in his DC home. Mr. Welch was caught and convicted in DC, escaped and was on the lam committing more crimes before being caught in Pennsylvania. DC did not have the death penalty...had the murder taken place across the street in Maryland, Mr. Welch could have been tried as a capital case and this scumbag may have been put down by now.
The Joseph Horn case in Florida IS "stand your ground" and the result was proper. The police DID NOT respond in time to catch the robbers and Mr. Horn insured those robbers would not plunder a community with elderly citizens again. The robbers were caught with stolen property in hand. Robbery does not only terrorize individual households, it terrorizes entire neighborhoods and communities, especially those with elderly inhabitants. It is good to see that a private citizen interrupted permanently the activities of two criminals who were supposedly known to the criminal justice system ("slapped on the hand for theft and released")...slow law enforcement response or appearance at criminal activity scenes makes "stand your ground" laws necessary.
Keep up the criticism of Stand your Ground, and there will be a Republican president and Congress. Just remember the 6 million NRA members helped tank the elections of Gore and Kerry because they favored gun control.
The Stand Your Ground laws are costing far fewer lives than the carnage that goes on in blue states where restrictive gun laws and crime run rampant.

I live in a Blue State and we have a very good SYG law. Too bad, the NRA/ALEC law allows innocent people to get killed and the killer to walk. BTW, I'm pro-gun and I'm a Liberal. Generlizes there, spaced?

I'm trying to understand why all of a sudden Republicans are finding these laws to be of the up most importance. I also wonder how would the law be applied if a black person killed a white person because they felt threatened. It just seems that when examples are shown as to why this law is necessary or was effective it is always a white person killing a black person. It just smells of a hidden agenda. This law is a path way to the days of the wild west. Anybody can kill anybody and claim I felt threatened and stood my ground. What gets me is the Republicans are supposed to be the party of christian conservatives but this law is the complete antithesis of "turn the other cheek".

do not take my explanation as to mean i agree . I do however get it. Some venues require the victim to run or evade the issue. Many that are at risk are old people like me. For me to evade is just dreaming I am crippled in the knees and can barely waddle away. To help keep people like me from being arrested for defending themselves this law was created. OK you hate it but now you at least understand it.

if Trevon was attacked absolutely. neither of these people were unable to cut and run they are not decrepit old people that I believe the law was meant to protect. IF Zimmerman was the aggressor approaching this kid and he had no badge and nothing to show authority but a gun the kid had the right to try to disarm Zimmerman and maybe even shoot him. That being said i don't know and neither do you. There are two separate thing on the calls that could go either way first Zimmerman was told to take a pass but on the same call he said the kid was approaching his car with his hand in his belt. Nothing on the call after that so it sounds like neither backed down Zimmerman was told to leave but maybe the kid got to him first. Who the hell knows. i am not going to defend either as it is my personal policy to only comment on things i know about like economics and on this one i know nothing and the speculators don't know any more than i do which is nothing.

Yes, Tray Martin had the right to "stand his ground" and so far, it seems that he did. The evidence thus shows that Zimmerman is a stalker (a crime) and a liar (also a crime in Florida as evidenced in the Casy Anthony trial). A trial jury has not yet decided if he is a stalker and a liar or a liar, stalker and murderer. In either case, no arrest has yet to be made in this abomination of the spirit of the law with its stupid caveats.
Yes, Americans lose their lives with these laws. It's a given. The States with the NRA/ALEC law *must* seriouly revisit it. It sucks. Seems to be interpreted as a license to kill and walk even with possible evidence to the contrary.
I believe that *good* "stand your ground" laws are necessary to protect those who use it legitimately to *defend* themselves both from harm and from civil liability from those found guilty of not following the law, whether incarcerated or deceased, including their families.
Even Gov. Jeb Bush has said that this law in not valid in the crime against Tray Martin. Does he regret signing this law as submitted?....no....that's a shame.
Does Robert Zimmerman, a retired magistrate judge, think his son should be arrested, while still being able to support a son who is still alive?....no.
Even in Texas, they are looking at their "stand you ground" law that was adopted in 2007.

They had a castle doctrine as all State's did for many years. I remember a repro-man was shot dead while doing his job about 30 years ago. The shooter was determined to be in his rights...no charges...IMO, it was not legal to give him a pass. My State had a castle doctrine too....except there has always been a swift, competant, initial investigation in our recent history and continues to be done with our "stand your ground" law and arrests are made.
Texas' new law has not helped any as you listen to the idiot, Joe Horn, in the video where he charged out of his house, after being told 12 times not to, and shot 2 men in the back for burglarizing a neighbor's home. Pretty stiff punishment for burlary. Horn was found not guilty. When was he in danger? Martin Bashir's report delves into the Texas law further.

But, it's not to late to ban guns because, IMO and the Constitution supports it, guns should not ever be banned in this Country.
I think there are too many opportunities with this to abuse "rights" or "freedoms".
Just like I disagree with ordinary citizens who believe they need weapons with hugh magazine cases which allows them to automatically shoot far too many bullets quickly. Why do ordinary citizens need this capability? Congress lady Gifford's incident was made worse by the capability?
I have no problem with your right to own guns...but logic tells me machine guns, and other multiple bullet capacity guns aren't necessary for hunters or gun lovers.
You remember when Ron Paul wanted to legalize heroin, lets take that further and legalize everything even murder. Hey none of us are going to go around killing unless we have a good reason too. And it is not like the laws are doing any good curbing murder. Better still lets make it mandatory that every man, woman and child need to carry a loaded gun, with that people will start treating each other with more respect.

When you can shoot two guys that are robbing your neighbors house and claim you were afraid for YOUR life, that's taking it TOO far! Especially when you're talking to the 911 operator and tell them you're going to go out of your house and shoot them while 911 is telling you not to. What a world we live in now. This Stand Your Ground law started with ALEC, the NRA and the Koch Brothers. Just another wonderful law they bought and paid for.

It is unfortunate that we have become a vigilante country. For what ever reason, far too many people feel they need to carry a loaded weapen at all times. Well, now, maybe they do have a need to. A very sad state to see our once great nation to sink to that level.

What has happened to our FREEDOMS. I just listened to a 911 call in Texas on Hardball. This person. shot 2 persons on his neighbor's yard because they were crawling out the window. Check out Hardball. Now more and more states can carry concealed weapons, and kill if feeling threatened. With everybody becoming Judge, jury, and executioner why have police or courts? (sarc.) Congress could cut lots cost to Gov., and pay down the debt.

If you watch what the republicans have been pushing all over the United States - they keep referring to our "founding fathers" and how we should go back to what they believed. What the Republicans are fogetting is that our founding fathers were alive in 1776!!! This is now 2012 - times have changed. Too bad the Republicans are fighting that change kicking and screaming! They want to live back in the old days when only certain people were in charge of everything. Everyone else was simply to fall in line and live with it. They are changing voter laws, voter registration laws, laws regarding women, gun laws, labor laws - all to give only 1 small part of the electorate a voice.

Rev. Sharpton and others are calling for Zimmerman to be arrested, but Fla. has a "right to a speedy trial" law and this new prosecutor wants to be really careful and have all her bases covered so Z can't get out of this, so she doesn't want a fast trial until SHE'S prepared. But, the thing they have to be careful of, since Z was arrested or so the lawman on the Rev's show said, they only have 170 days to re-arrest him or he could get out of this and if that happens all Hell is gonna break loose. The guy says he doesn't know how Z could have been arrested and then un-arrested that same night. I say it happened when the cops had the big summit meeting late Sunday night. Maybe because Daddy Z was a judge. So hopefully he gets charged before time runs out!

Perhaps it is related to the near 200 year period where these people were viewed as property and not people. Now before anyone wants to try and pretend that it was so long ago consider that it was legal to deny minorities of all types their rights to life, liberty and property a mere 50 years ago. We're really only four or five generations out from slavery.

There is absolutely nothing wrong with the Florida law. It allows a citizen to protect himself/herself if threatened.....period. Whether you like it or not, there is a growing number of citizens who legally carry concealed handguns. I am one of those. I hope I never have to fire my weapon, but I most certainly will if faced with a life-threatening situation.

When Zimmerman call 911, he should have left it up to the police. But remember on the 911 call were Zimmerman said these "a" holes always get away. This tell me that Zimmerman was determine that, that a hole( Trayvon Martin ) was not going to get away. Not this time, not if he could help it. And Trayvon Martin didn't get away.
